Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.
Background:
The Complainant is a software developer and worked for the Respondent from 12/02/2017 until 30/08/2019. He was promised a redundancy package but did not receive any payments. The Complainant submitted his complaint to the Workplace Relations Commission on 10/12/2019. |
Summary of Complainant’s Case:
The Complainant was informed in writing of the date and time of the hearing. There was no appearance by or on behalf of the Complainant at the hearing. I am satisfied that the said Complainant was informed in writing of the date, time and place at which the hearing to investigate the complaint would be held. |
Summary of Respondent’s Case:
The Respondent was informed of the date and time of the hearing. There was no appearance by or on behalf of the Respondent at the hearing. I am satisfied that the said Respondent was informed in writing of the date, time and place at which the hearing to investigate the complaint would be held. |
Findings and Conclusions:
There was no appearance by or on behalf of the Complainant or the Respondent at the hearing. Having reviewed the Case File it was evident that the letters to both the Complainant and the Respondent with an invitation to the hearing had been issued. There was no communication from either the complainant or the respondent in respect of same. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act.
Given the circumstances outlined above I find that the complaints are not well founded. |
