Procedure:
In accordance with Section 13 of the Industrial Relations Acts 1969following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the dispute.
Background:
This matter was heard by way of remote hearing pursuant to the Civil Law and Criminal Law (Miscellaneous Provisions) Act, 2020 and S.I. No. 359/2020 which designates the WRC as a body empowered to hold remote hearings. Both parties attended the initial hearing of the matter. Neither party attended the second hearing, however the employer notified the WRC in advance of the second hearing that they would not be in attendance. |
Summary of Worker’s Case:
The worker did not attend the scheduled hearing of this dispute. No reason was provided for non-attendance. |
Summary of Employer’s Case:
The employer did not attend the hearing of this matter and indicated in advance that it would not do so. It also indicated that it was happy for the hearing to proceed in its absence. |
Findings and Conclusions:
As neither party attended the hearing of this matter, I cannot find that the dispute was well founded. |
Recommendation:
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.
On the basis of the non-attendance of either party at the hearing of this matter, my recommendation is that the dispute is not well founded. |
