1.Pay Claim/Annual Leave And Health Insurance
BACKGROUND:
2.There are several interrelated elements to the within dispute which has been ongoing for some time: a pay claim retrospective to 1 January 2019; a claim for health insurance cover and a claim for improved annual leave entitlements.
In the context of the Parties’ discussions in relation to the foregoing, the Company has unequivocally stated its desire to introduce a modern time and attendance system for workers at its Carrigaline plant. The Unions’ stated position is that the time and attendance issue and the health insurance claim should be deferred until discussions commence locally in relation to a pay agreement for the period commencing 1 January 2021. The matter was referred to the Labour Court and a hearing took place on 7 January 2021
RECOMMENDATION:
Having considered in detail the Parties’ respective positions as set out in their written submissions, and having conferred with them through their Representatives, the Court is of the view that the Parties would benefit from further intensive and expeditious discussions at local level and/or under the auspices of the Conciliation Service of the Workplace Relations Commission with a view to achieving a mutually satisfactory and comprehensive resolution of all aspects of the within dispute simultaneously.
The Court remains available to assist the Parties, if needed, at the conclusion of the above process.
The Court so recommends.
