Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The complainant alleges that when she left the respondent she was owed outstanding wages and holiday pay. The respondent accepts this. |
Summary of Complainant’s Case:
The complainant worked for the respondent from 6th March 2019 until 21st January 202I. On Friday the 17th of January 2020 she was paid for hours from the previous week and extra hours worked over the Christmas period as well as holiday pay due up until this date. She was left short of hours and after contacting the owner by email, he agreed to pay these in her last pay. The complainant believes she was not paid the full amount due and has calculate the shortfall as being €135 inclusive of both hours worked but not paid for, and holiday pay due. |

The respondent acknowledges that the money is due and had offered to pay the sum involved |
Findings and Conclusions:
Both parties are in agreement that there is a sum of money outstanding that is due to the complainant. The complaint is well founded and the total owed is €135. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
I order the respondent to pay the complainant the sum of €135 |
