Procedure:
In accordance with Section 8 of the Unfair Dismissals Acts, 1977 - 2015, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
At the time the adjudication was scheduled to commence, it became apparent that there was no appearance by or on behalf of the Complainant. I verified that the Complainant was on notice of the adjudication hearing and after waiting some time to accommodate any difficult he may have in attendance, I proceeded with the adjudication in the absence of the complainant.
Background:
On 19 August 2020, the Complainant made a complaint to the Workplace Relations Commission pursuant to the Unfair Dismissals Acts, 1977 - 2015. The complaint was scheduled for adjudication on 2 July 2021. |
Summary of Complainant’s Case:
The Complainant did not attend the adjudication to prosecute his case. |
Summary of Respondent’s Case:
The Respondent attended the adjudication hearing but given the failure of the Complainant to prosecute their case, it was unnecessary to hear evidence from the Respondent. |
Findings and Conclusions:
The complaint made pursuant to the Unfair Dismissals Acts, 1977 - 2015 is not well founded as the Complainant failed to prosecute this claim. |
Decision:
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
