Procedure:
In accordance with Section 41 of the Workplace Relations Act, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
This matter was heard by way of remote hearing pursuant to the Civil Law and Criminal Law (Miscellaneous Provisions) Act, 2020 and S.I. No. 359/2020 which designates the WRC as a body empowered to hold remote hearings. The complainant was employed by the respondent from 6 January 2020 until 15 September 2020. |
Summary of Complainant’s Case:
The complainant submitted that at the termination of his employment he was owed outstanding wages of €4920.00. He submitted that he received €1000 towards the end of October and a further €1000 in early November. The complainant submitted that he is owed the outstanding balance of €2920.00 |
Summary of Respondent’s Case:
The respondent submitted that it had paid the complainant the balance of the monies owing to the complainant on the working day prior to the hearing date. |
Findings and Conclusions:
The complainant confirmed that he received the outstanding amount owed to him the day prior to the hearing. He clarified that he received €1000 in October 2020, €1000 in November 2020 and the balance of €2920 in June 2021 mand that no further monies are due to him. Having regard to the confirmed payments made to the complainant, no further sum remains to be paid to the complainant. Accordingly, I find that, as at the date of hearing, this complaint is not well founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
Having regard to the agreed facts of this case, my decision is that as of the date of the hearing, this complaint is not well founded. |
