Procedure:
In accordance Section 13 of the Industrial Relations Acts 1969 following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the dispute by remote hearing.
Background:
The dispute relates to grade classification that in turn determines what salary scale to be placed on. |
Summary of Worker’s Case:
The worker states that he has been placed on the wrong scale |
Summary of Employer’s Case:
The employer accepts that an administrative error has occurred and following discussions between the parties, the following settlement was agreed and in turn both parties requested that it constitute a recommendation. |
Findings and Conclusions:
The parties have amicably arrived at a settlement to the dispute. |
Recommendation:
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.
The parties have been anonymised and the following has been agreed between the worker and the employer and forms a recommendation as per Section 13 of the Industrial Relations Act, 1969.
Workplace Relations Commission Settlement Agreement ADJ: 00028343 CA: 00036370 3rd March 2021 The parties to the above Workplace Relations Commission complaint have agreed to the following terms as a resolution to the matters: • The Employer confirms that the Doctor was incorrectly placed on a NCHD Senior House Officer contract in January 2020. • The Employer confirms that the worker has been working as a NCHD Registrar since July 2019 to date. • The Employer agrees to backdate payment to the worker from 15th December 2020 at Registrar point 3, as per appendix 1. • The Employer agrees that the worker’s increment date will change to 15th December going forward, i.e., where he will be placed on Registrar point 4 on 15th December 2021. • This settlement is specific to the worker.
