1.Living Wage, Sunday Premium, Overtime, Laundry Allowance, Service Recognition, Time Off for Union Representatives , Guaranteed Weekly Hours.

BACKGROUND:

2.This is a referral under Section 26 (1) of theIndustrial Relations Act 1990.This was received by the Labour Court on 6th January 2021. A Labour Court Hearing took place in a virtual courtroom on 18th March 2021.

RECOMMENDATION:

In circumstances where the parties are unable to agree about what issues are properly before the Court and are in disagreement about what occurred at conciliation, the Court is not in a position at this point to offer assistance in the resolution of the matters before it.

Therefore, the Court recommends that the parties re-engage with the assistance of the WRC immediately and that further attempts be made by both parties to resolve all issues between them. If there are issues which, following such engagement, cannot be resolved by a date of one month from the date of this Recommendation, the parties may refer such issues back to the Court.

If there are matters being referred to the Court at that point, the Court emphasises the desirability, for all parties, of ensuring that there is clarity as to what issues are being referred and that there is clarity on the positions of the respective parties regarding any such issues when conciliation is concluded.
