BACKGROUND:

2.This is an appeal of an Adjudication Officer’s Decision made pursuant to Section 7(1) of the Payment of Wages Act, 1991. The appeal was heard by the Labour Court on 10 March 2021 in accordance with Section 44 of the Workplace Relations Act, 2015. The following is the Court's Determination:-

DETERMINATION:

This is an appeal by Amelie Deinhard against an Adjudication Officer’s Decision given under the Payment of Wages Act 1991(the Act) in her claim that she suffered an unlawful deduction from her wages on 19^thOctober 2018.

The Adjudication Officer decided that the complaint was not well founded.

The hearing of the Court.

On the day before the hearing of the Court the Appellant made contact with the Court to advise that she would not attend the scheduled hearing of her appeal. On the day of the hearing, the Appellant did not appear before the Court.

The Court concluded that, the Appellant not being present to move her appeal, the appeal must fail. In coming to this conclusion, the Court satisfied itself that the Appellant had been properly made aware of the date, time and venue for the hearing of her appeal.

Determination

For the reasons outline above the appeal does not succeed and the decision of the Adjudication Officer is affirmed.
