BACKGROUND:

2.The Employer appealed the Decision of the Adjudication Officer to the Labour Court on 18 May 2020 in accordance with the Redundancy Payments Acts 1967 to 2014. A Labour Court hearing took place on 3 March 2021. The following is the Determination of the Court:

Background

This is an appeal by Plaza Express Stores, ‘the Respondent’ of an Adjudication Officer Decision that redundancy should be paid to Ms. Price, ‘the Complainant’, in accordance with the terms of the Redundancy Payments Act 1967.

Issue for Consideration

The Respondent failed to appear for the Court hearing. The Respondent’s representative confirmed that the Respondent was aware that the hearing was taking place. The representative confirmed that she had spoken to her client regarding the hearing but had been unable to make contact with her in the days leading up to the hearing and on the day of the hearing itself.

Deliberation

The Court noted that the appellant was not present to make their appeal, despite being aware that the appeal was taking place. In the circumstances, the Court noted that there was not a valid appeal before it for consideration.

Determination

The Decision of the Adjudication Officer is upheld.
