Procedure:
In accordance with Section 8 of the Unfair Dismissals Acts, 1977 - 2015] following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background
The claimant commenced employment with the respondent on the 1st of August 2018 and he was dismissed on the 19th of February 2018 for gross misconduct.
This matter was heard by way remote hearing pursuant to the Civil law and Criminal Law (miscellaneous Provisions) Act 2020 and SI 359/20206, which designates the WRC as a body empowered to hold remote hearings.
No objections to the remote hearing.
Findings
The claimant was advised of the time and date of the remote hearing.
Time was allowed for the claimant to attend just in case he may have been delayed.
However, no contact was received by the service from him.
I find that the complaint was not prosecuted.
Decision:
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I decide in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
I have decided based on the above findings the complaint for Unfair dismissal falls.
