BACKGROUND:
2.The Worker appealed the Decision of the Adjudication Officer to the Labour Court on 6 May 2020. A Labour Court hearing took place on 14 May 2021. The following is the Court's Determination:
DETERMINATION:
This is an appeal by Halima Vickers (the Complainant) against decision ADJ-00022126 of an Adjudication Officer under the Employment Equality Acts 1998 to 2015 (the Acts). The Adjudication Officer held that the Complainant failed to establish a prima facie case of discrimination on the ‘civil status’ ground and therefore her claim failed. At the start of the Court hearing the Complainant confirmed that she was not discriminated against based on her civil status. The Complainant stated that her complaint is not based on one of the nine grounds set out in the Acts. The Complainant stated that she thought if she selected one of the nine grounds that her complaint could be heard. As there is no complaint in respect of one of the nine grounds covered by the Acts the Court does not have jurisdiction to hear the case and the appeal must fail.
