Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
There was no attendance by either party. A member of staff at the WRC stated that he made attempts by email and telephone to contact the Complainant. There was no reply to his contacts and the phone rang out. The person named for the Respondent informed the same member of staff that he is no longer employed by the Respondent. Correspondence sent to the Respondent address was returned marked ‘gone away’.
Background:
The case concerns a complaint of underpayment of wages not transferred to the Complainants account and also holiday pay for the duration of the employment as set out on the complaint form-01/10/20 -03/02/2020. |

Findings:
On the basis of the information provided to me by the WRC, I am satisfied that the Complainant was properly notified of the hearing and that every reasonable effort was made to ensure he was aware of the hearing and could attend remotely. As no evidence was presented to support the complaint, it is not well founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
