Procedure:
In accordance with Section 13 of the Industrial Relations Acts 1969, following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the dispute.
Background:
This matter was hosted by way of Remote Hearings in private pursuant to Civil Law and Criminal Law (Miscellaneous Provisions) Act, 2020 and SI 359/2020, which designates the WRC as a body empowered to hold remote hearings. The Dispute lodged on 7 October 2020 referred to the circumstances surrounding a Redundancy in June 2020. The claim was strongly contested by the Employer Representative, who argued that the claim was a mirror claim to one made concurrently under separate legislation. Written submissions were made by both parties in the case. |
Summary of Workers Case:
The Worker in this case is a Sacristan, who has worked continuously from 1994, signing a contract of employment in 2009. He claimed that he was informed of his Redundancy in June 2020. He challenged the circumstances of this Redundancy.

Summary of Employer’s Case:
The Employer is a Priest who manages a Parish Community. He had disputed the claim made. |
Findings and Conclusions:
This dispute was linked to a separate case, which was heard in Public. I have read both submissions tendered by the parties. On August 26, 2021, the Worker Representative was invited to open the claim in private. At that point, he confirmed that he would not be advancing the claim and withdrew it. This was accepted as withdrawn by the Employer representative. |
Recommendation:
Section 13 of the Industrial Relations Acts, 1969 requires that if I identify merit in the claim, I can make a recommendation in relation to the dispute. I am satisfied that this claim has been withdrawn during the August 26, 2021 hearing, held in private. This outcome was acknowledged by both parties.
