SUBJECT: 1.59 Workers wish to be represented by Siptu on a collective basis.
BACKGROUND:
2.This dispute was referred to the Labour Court on 6 August 2021 in accordance with Section 20 (1) of the Industrial Relations Act, 1969. A Labour Court hearing took place on 28 October 2021 in a virtual Court room.
The Company did not attend the virtual Court hearing but wrote to the Court to say that they were satisfied that the existing consultative mechanisms in the company operated effectively.
UNION’S ARGUMENTS:
3. 1. The Union is seeking 59 workers to be represented on a collective basis. RECOMMENDATION:
The Court recommends that the Company should recognise the Union, for all industrial relations purposes, as the chosen representative of those employees who join the Union.
The Court further recommends that the parties enter into negotiations with a view to concluding a collective agreement on the procedural arrangements within which normal industrial relations business can be conducted between them.
