SUBJECT: 1.Appeal Of Adjudication Officer Decision No. ADJ-00031849 CA-00042369-001
BACKGROUND:
2.The Worker appealed the Adjudication Officer’s Recommendation to the Labour Court on 17 August 2021 in accordance with Section 13(9) of the Industrial Relations Act, 1969.
On 9July 2021 the Adjudication Officer issued the following Recommendation:-
“I recommend that the employee accept the employers offer to replace the Final Written Warning with a Written Warning.” A Labour Court hearing took place on 12 November 2021.
DECISION:
Recommendation
The Court notes that the warning given to the Worker has expired, that the Employer confirmed that the warning has been expunged from the Worker’s record and that the Worker has since moved on to a new phase of his life. The Court recommends that the parties accept that the matter is resolved.
