Procedure:

In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.

Background:

The Complainant commenced employment with the Respondent on 12th August 2019. The employment ended on 26th January 2020.

On 17th May 2020, the Complainant lodged eight identical complaints with the Commission. A hearing in relation to these matters was convened and finalised for 5th August 2021. No issues as to my jurisdiction to hear the complaint were raised at any stage.

Summary of Complainant’s Case:

The Complainant did not attend the hearing. No application for adjournment of the hearing was received in advance, nor was any reason for the non-attendance issued thereafter. Having reviewed the file, I am satisfied that the Complainant was on notice of the date and time of the hearing.

Given that neither party attended the hearing, I find that the complaints are not well founded.

Decision:

Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act.
