Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and/or Section 79 of the Employment Equality Acts, 1998 - 2015, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant commenced employment with the Respondent on 01/02/1994. This complaint was received by the Workplace Relations Commission on 31st March 2020 and is almost an exact replica of a complaint submitted on behalf of the Complainant the previous day. The only difference is that this complaint named the Respondent as IDA Ireland, the complaint from 30th March 2020 names the Respondent as IDA. This complaint states the Complainant has approximately 28 years’ service. The complaint on 30th March states approximately 24 years’ service. In all other respects they are the same complaint. Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
