Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant was employed as a sales assistant from 10th June 2019 until 15th July 2019. |
Summary of Complainant’s Case:
The Complainant was employed for three weeks but was not paid for all hours worked. He is owed €600. He resigned as he was not being properly paid for work done. The Complainant did not attend the hearing. |
Summary of Respondent’s Case:
The Respondent’s correct name is Centz stores 6 Ltd and consent to the change of name. A contract of employment issued to the Complainant setting out his hours and pay. The Respondent applied to dismiss the claim due to non-attendance of the Complainant. |
Findings and Conclusions:
I order that the Respondent’s title in the complaint is changed to their correct title of Centz Stores 6 Ltd. There was no appearance by or on behalf of the complainant at the hearing. I am satisfied that the complainant was informed in writing of the date, time and place at which the hearing to investigate the complaint would be held. In these circumstances, I must conclude that the within complaint is not well-founded.

Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
The complaint is not well founded. |
