Procedure:
On the 22nd February 2021, the complainant submitted a complaint pursuant to the Unfair Dismissals Act. It was scheduled for adjudication following a Zalewski postponement to the 17th August 2022.
At the time the hearing was to commence, it was apparent that there was no attendance by or on behalf of the complainant. I verified that the complainant was on notice of the date, time and venue of the hearing and waited some time to accommodate a late arrival. The complainant did not attend, and I opened the hearing. The respondent, represented by Sinead Finnerty, Peninsula, were in attendance.
In accordance with section 8 of the Unfair Dismissals Acts, 1977 - 2015following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

Findings and Conclusions:
The complainant did not attend the hearing to set out how there had been a contravention of the Unfair Dismissals Act. I, therefore, deem that the complaint is not well-founded, and I dismiss the complaint. |
Decision:
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act or to dismiss the complaint of unfair dismissal.
