Procedure:
In accordance with section 39 of the Redundancy Payments Acts 1967 – 2022,following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
This complaint was received by the Workplace Relations Commission on 27 April 2022. The Commission notified the Respondent and enclosed copy of the complaint on 14 June 2022. A hearing was scheduled for 10 November 2022. There was no attendance at the hearing by, or on behalf of, either the Complainant or the Respondent. No communication was received by either party to give a reason for their non-attendance. |

Based on the complaint form, this complaint concerned non-receipt of a redundancy payment. Notice of the hearing arrangements was sent to the Complainant on 7 October 2022. The Complainant did not attend at the scheduled hearing. No explanation for the Complainant’s non-attendance at the hearing has been received by the Workplace Relations Commission. |

Findings and Conclusions:
A complaint pursuant to the Redundancy Payments Act, 1967 was received by the Workplace Relations Commission on 27 April 2022. The said complaint was referred to me for adjudication. A hearing for that purpose was arranged for 10 November 2022. There was no attendance by either party at the hearing. I am satisfied that the parties were informed in writing of the date, time and place for the hearing of the complaint. In the circumstances and in the absence of direct evidence, I must conclude that the complaint is not well-founded. |
Decision:
Section 39 of the Redundancy Payments Acts 1967 – 2022 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.
For the reasons given above, I find that the complaint is not well-founded. |
