Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Summary of Complainant’s Case:
The complainant worked for the respondent for a number of weeks and says that she was not paid for three days at the end of her period of employment. She also says she is due payment for the St. Patrick’s Day public holiday. |
Summary of Respondent’s Case:
The respondent outlined that, while the complainant had been working with it for a number of weeks, the first period of three weeks was as an agency employee. She only became directly employed by the respondent in Week 12 (approximately March 14th,) and remained in direct employment for a further two weeks. The respondent submitted payslips for both weeks which showed payment of wages in full to the complainant. The claim for payment for the public holiday also related to a period when the complainant was not a direct employee. The respondent says no wages or other payments are outstanding. |
Findings and Conclusions:
The situation is as set out as above and the complainant accepted in the course of the hearing that there had been a misunderstanding about her position as between the agency and the respondent. Accordingly, I find that no wages or other payments are outstanding, and the complaint is not well-founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
For the reasons set out above, complaint CA-00050579-001 is not well-founded. |
