FULL RECOMMENDATION
SECTION 20(1), INDUSTRIAL RELATIONS ACT, 1969 PARTIES: CLEAR SKIN AND LASER CLINIC LTD - AND - A WORKER (REPRESENTED BY MS PAMELA KEEGAN, B.L.) DIVISION:
SUBJECT: 1.Unfair Dismissal. The Court has given careful consideration to the submission of the Claimant in this case. As the employer did not attend the hearing, the Court was deprived of any understanding of the employer’s perspective. On the basis of the uncontested submission of the Claimant the Court concludes that no fair procedures were employed in arriving at the decision to terminate the Claimant’s employment. As a result the Court finds she was unfairly dismissed. In all of the circumstances the Court recommends that the employer pay to the Claimant the sum equivalent to four weeks’ pay as compensation in full and final settlement of the matter in dispute. The Court so recommends.
