Procedure:
In accordance with Section 13 of the Industrial Relations Acts 1969following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the dispute.
Specifically, I conducted a remote hearing in accordance with the Civil Law and Criminal Law (Miscellaneous Provisions) Act 2020 and Statutory Instrument 359/2020 which designates the Workplace Relations Commission as a body empowered to hold remote hearings.
Background:
The Worker commenced employment with the Employer on 4 November 2019 and was paid a salary of €1,700 per month. His employment ended on 15 June 2020 and he stated on the complaint form that he was unfairly selected for redundancy. |
Summary of Worker’s Case:
Although the Worker’s representative attended the hearing, the Worker himself failed to do so and his representative could not make contact with him. |
Summary of Respondent’s Case:
The Respondent attended the hearing. |
Findings and Conclusions:
In the absence of any evidence from the Worker in relation to his dispute, I cannot make a recommendation that is favourable to him. |
Decision:
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.
I cannot make a recommendation that is favourable to the Worker for the reasons set out above. |
