1.Appeal of Adjudication Officer Decision No. ADJ-00022744 CA-00029580-002

BACKGROUND:

2.The Worker appealed the Adjudication Officer’s Recommendation to the Labour Court on 15 September 2020 in accordance with Section 13(9) of the Industrial Relations Act, 1969.

On 7 September 2020 the Adjudication Officer issued the following Recommendation:-

“The complaint as presented is not well found.”

A Labour Court hearing took place on 19 November 2021.

DECISION:

Background

This is an appeal by the Worker of Decision ADJ-00022744 of an Adjudication Officer in respect of the Worker’s complaint concerning issues occurring in the workplace. The Adjudication Officer held that the Complaint as presented was not well founded. In advance of the hearing the Worker advised the Court secretariat that she would not attend the hearing and also, that she did not wish to withdraw her appeal. On the day of the hearing no grounds were put forward that would lead the Court to conclude that it should overturn the decision of the Adjudication Officer therefore the Court decides that the appeal fails.

The Decision of the Adjudication officer is upheld

The Court so decides.
