Procedure:
In accordance with Section 79 of the Employment Equality Acts, 1998 - 2015following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
The Complainant emailed the WRC on 15 June stating that he would be unable to attend the hearing the following day. Although he was informed via email reply that he could apply for a postponement, he failed to do so and the hearing proceeded in his absence.

The Complainant did not attend the hearing to give evidence in relation to his complaint. |
Summary of Complainant’s Case:
Despite having been notified of the time and date of the hearing, the Complainant failed to attend and did not make any postponement request in advance of the hearing. |
Summary of Respondent’s Case:
The Respondent did not present any evidence although two witnesses attended on their behalf and were prepared to give evidence. |
Findings and Conclusions:
As the Complainant failed to present any evidence in relation to his complaint, I find that he has not established a prima facie case of discrimination. |
Decision:
Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
As the Complainant did not establish a prima facie case of discrimination, I find that he was not discriminated against. |
