Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and/or Section 8 of the Unfair Dismissals Acts, 1977 - 2015, following the referral of the complaint(s) to me by the Director General, I inquired into the complaint(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s).
Background:
The Complainant was employed by the Respondent as a Social Care Worker. She commenced employment on 28th May 2007 and employment ended on 2nd September 2021. This complaint was received by the Workplace Relations Commission on 3rd September 2021. |
Summary of Complainant’s Case:
The Complainant did not attend the hearing scheduled for 10.30am on Monday 11th July 2022. The Complainant was notified of the arrangements for the hearing on 18th May 2022, this notification included the time, date and venue for the hearing of the complaint. |
Summary of Respondent’s Case:
The Respondent was legally represented at the hearing. The Respondent was prepared to present a full defence against the complaint. |
Findings and Conclusions:
On Friday 8th November 2022 at 10.04 pm the Complainant sent an email to the Workplace Relations Commission stating the following: “Thank you for your email, I can’t attend I am currently away on travels. Is there a possibility to re-schedule? Thank you” I have considered this matter and find that the above does not constitute a reasonable explanation or excuse to consider re-scheduling the hearing of the complaint. I find that the complaint is not well founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
I find that the complaint is not well founded. |
