Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
This matter was heard by way of remote hearing pursuant to the Civil Law and Criminal Law (Miscellaneous Provisions) Act, 2020 and S.I. 359 of 2020, which designates the WRC as a body empowered to hold remote hearings.
Background:
Although I am satisfied that the Complainant was on notice of the time and date of the hearing, he did not attend to give evidence in relation to his complaint. |
Summary of Complainant’s Case:
Despite having been notified of the time and date of the hearing, the Complainant failed to attend and did not make any postponement request in advance of the hearing. |
Summary of Respondent’s Case:
The Respondent did not present any evidence although one witness attended on their behalf and was prepared to give evidence. |
Findings and Conclusions:
The Complainant failed to attend the hearing to present any evidence in relation to his complaint. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
As the Complainant failed to present any evidence in relation to his complaint, I find that his complaint is not well founded. |
