Complaint seeking adjudication by the Workplace Relations Commission under section 77 of the Employment Equality Act, 1998 | CA-00041349-001 | 01/12/2020 |
Date of Adjudication Hearing: 14/06/2022
Workplace Relations Commission Adjudication Officer: Conor Stokes
Procedure:
In accordance with Section 79 of the Employment Equality Acts, 1998 - 2015,following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The hearing was scheduled to start at 9.00, however the complainant was not in attendance. A grace period was allowed to enable the complainant to attend or make contact with the WRC. When no contact was made with the WRC, the hearing commenced at 9:27 and closed at 9:30. No correspondence has been received from the complainant in the intervening period. |
Summary of Complainant’s Case:
The complainant submitted that he was discriminated against during the recruitment process. |
Summary of Respondent’s Case:
The respondent denied discrimination against the complainant during the recruitment process. |
Findings and Conclusions:
As the complainant did not attend the hearing of this matter, no evidence was presented to me establishing this claim. Hearing notification letters issued both parties on 21 April 2022, consequently I am satisfied that the complainant is on notice. He has offered no explanation for his absence. Accordingly, I find that the complainant was not discriminated against. |
Decision:
Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
My decision is that the complainant was not discriminated against. |
