Complaint seeking adjudication by the Workplace Relations Commission under section 6 of the Payment of Wages Act, 1991 | CA-00047370-001 | 28/11/2021 |
Date of Adjudication Hearing: 01/11/2022
Workplace Relations Commission Adjudication Officer: Gaye Cunningham
Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The complaint is that the Respondent did not pay the full wages due to the Complainant.
|
Summary of Complainant’s Case:
The Complainant had submitted a complaint received on 28th November 2021 that he was owed 67.5 hours pay at the end of his employment. The Complainant, having been notified of the date, time and venue for his complaint to be heard, did not attend the hearing. |
Summary of Respondent’s Case:
The Respondent submitted documentation showing that the Complainant’s claim for payment for hours and annual leave had been fully met. |
Findings and Conclusions:
I am satisfied that the Complainant was notified of the arrangements for the hearing convened to consider his complaint and he did not attend. Further, I note the reconciliation paperwork submitted by the Respondent which was sent to the Complainant around the time, or shortly after he submitted his complaint. I find his complaint to be not well founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act. I have decided that the complaint is not well founded.
Dated: 9th November 2022.
