Procedure:
In accordance with Section 13 of the Industrial Relations Acts 1969, following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the dispute.
Background:
The Worker is employed as a paramedic in the ambulance service since the 15th March 1997. This is a dispute under the Industrial Relations Act 1969 concerning a sanction imposed on the Worker. |
Summary of the Dispute:
The Worker and her colleague attended an ambulance call out on the 15th October 2019. Their manager together with 2 trainees had arrived at the patient’s house before them. A dispute with the manager occurred resulting in the Worker and her colleague being stood down. Following a report from the manager the Workers were called to a stage 4 disciplinary hearing which resulted in a stage 2 warning being issued to both workers. The sanction is now exhausted. The Worker is seeking to have it expunged. |
Findings and Conclusions
It was agreed by the parties that the matter should be resolved by the following statement: That the Employer acknowledges that there was no evidence of any wrongdoing by any party and in light of that, the sanction that was imposed on the Worker was without proper foundation The Employer formally apologises to the Worker for the failure of the process and the difficulties it has caused her. |
Recommendation:
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.
I recommend the resolution of the dispute on the above terms |
