Procedure:
In accordance with section 41 of the Workplace Relations Act 2015, section 8 of the Unfair Dismissals Acts 1977 – 2015 and section 79 of the Employment Equality Acts 1998 - 2015, these complaints were assigned to me by the Director General. The hearing opened on June 30th 2022, but was adjourned at the request of the complainant, when he asked for time to get legal advice. The hearing resumed on September 21st 2022. The respondent attended and he was represented by Mr Ronan O’Brien of Ronan O’Brien and Company, Solicitors. The complainant did not attend, although I am satisfied that he was properly on notice of the hearing. Having waited for Mr Porter for 30 minutes after the start time of 9.30am, I concluded the hearing without making any enquiries into his complaints.
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act. Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act. Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
In the circumstances where the complainant did not attend the hearing, and, in the absence of any evidence to the contrary having been submitted, I must conclude that these complaints are not well-founded, and I decide accordingly. |
