Complaint seeking adjudication by the Workplace Relations Commission under Section 21 Equal Status Act, 2000 | CA-00045153-001 | 13/07/2021 |
Date of Adjudication Hearing: 14/09/2022
Workplace Relations Commission Adjudication Officer: Pat Brady
Procedure:
In accordance Section 25 of the Equal Status Act, 2000, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Summary of Complainant’s Case:
The complainant was in attendance for the beginning of the hearing but left before it commenced. |
Summary of Respondent’s Case:
The respondent was in attendance. |
Findings and Conclusions:
At the outset of the hearing the complainant became disruptive and abusive and indicated that he would not participate in the proceedings. He was advised of the risk that a decision could be made on his complaint if he did not present it for consideration and adjudication. He left the hearing room and on checking and getting confirmation that he had also left the WRC building the hearing was terminated. Accordingly in the circumstances of his having been given the opportunity to present his complaint and unreasonably failing to do so, I conclude that it was not well-founded, and it fails. |
Decision:
Section 25 of the Equal Status Acts, 2000 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 27 of that Act.
For the reason set out above complaint CA-00045153-001 is not well founded and it is dismissed. |
