Procedure:
In accordance with Section 8 of the Unfair Dismissals Acts, 1977 – 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant referred a claim alleging he was unfairly dismissed. The Respondent disputed the fact of dismissal. |
Summary of Complainant’s Case:
The Complainant failed to attend a hearing of the case arranged for the 15th of September 2022. |
Summary of Respondent’s Case:
The Respondent’s HR Manager and representative attended at the hearing on behalf of the Respondent. The Respondent’s representative applied to have the Complainant’s case struck out for want of prosecution. |
Findings and Conclusions:
This claim was received by the Workplace Relations Commission on the 4th November 2021. The claim was referred to me for adjudication by the Director General. A hearing for that purpose was scheduled for the 15th September 2022. There was no appearance by or on behalf of the Complainant at the hearing. I am satisfied that a letter dated 9th August 2022 issued to the email address provided by the Complainant in respect of this claim, informing him of the date, time and place of the hearing of the claim. No communications have been received from the Complainant in the interim indicating any difficulty attending at the hearing, seeking a postponement or withdrawing this claim. In the circumstances and in the absence of any evidence to the contrary, I must conclude that the within claim is not well founded and I decide accordingly. |
Decision:
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
For the reasons set out above, I find that complaint CA-00046983-001 is not well founded. |
