Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 13 of the IndustrialRelations Acts 1969] following the referral of the complaint(s)/dispute to me by the Director General, I inquired into the complaint(s)/dispute and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/disputes.
Background:
The worker submitted various disputes/complaints to the WRC on 4 April 2023. The parties were notified of a hearing by the WRC. There was no contact from the Respondent at any stage and post from the WRC was returned from the address of the business. Efforts to contact the Respondent/former employer by WRC staff arranging the remote hearing were unsuccessful. It is understood that the business has ceased at the address provided. On December 4th, 2023, the worker sought a postponement which was not granted by the WRC as information requested to support the application was not provided. As neither party attended the hearing there was no inquiry into the complaint/dispute. As there was no appearance and in light of the privacy accorded to hearings under the Industrial Relations Act 1969, I have anonymised the full text of the decisions/recommendations.

Findings and Conclusions:
In the absence of evidence to support the complaints, I cannot investigate the complaints and therefore must decide they are not well founded. In the absence of any attendance at the hearing of the disputes under the Industrial Relations Act, I recommend that the worker regard those matters as closed. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.
