Complaint seeking adjudication by the Workplace Relations Commission under the Industrial Relations Acts | CA-00050143-001 | 02/05/2022 |
Date of Adjudication Hearing: 02/12/2022
Workplace Relations Commission Adjudication Officer: Breiffni O'Neill
Procedure:
In accordance with Section 13 of the Industrial Relations Acts 1969 following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the dispute.
Neither party attended the hearing to give evidence on the day. The Respondent stated in correspondence in advance of the hearing that they would not be present. Although, I am satisfied that he was on notice of the time and date of the hearing, the Worker did not contact the WRC in advance either to explain his failure to attend or seek a postponement.
Background:
In his complaint form, the Worker stated that he began his employment with the Employer on 17 January 2021. He further stated that he was dismissed from his employment on 24 March 2021 and claimed that this was unfair. |
Summary of Worker’s Case:
The Worker did not attend the hearing to give evidence. |
Summary of Respondent’s Case:
The Respondent did not attend the hearing to give evidence. |
Findings and Conclusions:
No evidence was presented at the hearing on the day. |
Decision:
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.
Given the failure of the Worker to attend the hearing on the day, I cannot make a recommendation that is favourable to him. |
