Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.
Background:
These complaints were submitted on the 7th of July 2022 by the Complainant against the Respondent.
A hearing was held on the 28th of March 2023 via Webex platform.

Findings and Conclusions:
I have reviewed the file available to me and spoken with the WRC official involved with setting up the Webex hearing. The Complainant provided two emails to the WRC and had corresponded with the WRC using email in the past. The hearing notifications went to both these emails. The WRC further used the email addresses and phone numbers on file to contact with the Complainant in the run up to the Webex hearing but received nothing back. The WRC notified the Respondent using the postal address provided by the Complainant. On review of the Respondent’s website this address appears to still be in use. A WRC official called the Respondent’s emergency number provided on their website multiple times but these calls were unanswered. On the day of the hearing I allowed for 30 minutes for either party to attend via Webex. Neither did. I closed the hearing and allowed for a week to elapse so either party might to my attention any issue that might have prevented them attending on the day. No such communication was received so I proceeded to issue this decision. As neither party attended the hearing the complaints must fail. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act.
