In accordance with section 13 of the Industrial Relations Act 1969 (as amended), this dispute was assigned to me for adjudication by the Director General. A remote hearing was arranged for March 8th 2023 at 11.30am, for the parties to present evidence in relation to the dispute. The post-master attended the hearing, and he was represented by Mr Gareth Kyne. At 10.15 on the day of the hearing, the complainant sent an email to the remote hearing concierge, advising him that she would not attend the hearing. He replied, explaining that, if she did not attend, her dispute could not be investigated and the outcome would be a recommendation that her former employer should take no further action. He asked her if she wished to change her mind. At 11.34, she replied saying, “I just can’t today.”
Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
In the circumstances in which the complainant did not attend the hearing, I recommend that the employer takes no further action regarding the matter in dispute. |
