Procedure:
In accordance with Section 79 of the Employment Equality Acts, 1998 – 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant was employed by the Respondent as a ‘fish worker’ from 1st April 2022 until 5th July 2022. The Complainant alleges that he was discriminated against on the disability ground. The Complainant also alleges that he was victimised by his former employer. The complaint also relates to an allegation by the Complainant that he was dismissed for discriminatory reasons. |

Summary of Respondent’s Case:
The Respondent attended the hearing. The Respondent submits that as neither the Complainant nor his representative was in attendance to pursue the complaint, the complaint should be dismissed for want of evidence. |
Findings and Conclusions:
The complaints were received by the Director General of the Workplace Relations Commission on 18th July 2022 whereby the complainant alleged that his former employer contravened the provisions of the Employment Equality Act, 1998 in relation to him. The complaint was assigned the complaint application number CA-00051729-002. The said complaint was referred to me for investigation. A hearing for that purpose was arranged for 19th June 2023. There was no appearance by or on behalf of the Complainant at the hearing. I am satisfied that the Complainant was properly on notice of the hearing. |
Decision:
Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
In all of the circumstances of the matter, I must conclude that the within complaint (CA-00051729-002) is not well-founded and I decide accordingly. |
