Procedure:

In accordance with Section 25 of the Equal Status Act, 2000,following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

Background:

The Complainant brings a complaint of racial discrimination. However, neither the Complainant or the Respondent attended at the hearing.

Summary of Complainant’s Case:

The Complainant failed to attend at the hearing and to present their case.

Summary of Respondent’s Case:

The Respondent failed to attend at the hearing and to present their case.

Findings and Conclusions:

A witness for the Respondent did attend at the hearing.

The Complainant consented to be communicated by electronic means.

The Respondent was notified of the hearing by post.

I am satisfied that the Complainant was notified of the date, time and place of the hearing and failed to attend.

In these circumstances I determine that the Complainant was not discriminated against, and that the Respondent did not engage in prohibited conduct.

Decision:

Section 25 of the Equal Status Acts, 2000 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 27 of that Act.

I am satisfied that the Complainant was notified of the date, time and place of the hearing and failed to attend.

In these circumstances I determine that the Complainant was not discriminated against and that the Respondent did not engage in prohibited conduct.
