Procedure:
In accordance with Section 25 of the Equal Status Act, 2000,following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Two complaints under the Equal Status Act 2000 were recorded as received by the WRC-submitted by Brendan and Anette Igoe. On reviewing the file it is likely that it was intended that there would be one complaint heard. As the existence of duplicate complaints could not be verified at the hearing, decisions are issued under two reference numbers ADJ-00044021 and ADJ-00044029.
The separate complaints as recorded led to two hearing times being set for the same day-10 August 2023 at 10 30 and 1 30 respectively. Prior to the hearing the parties were informed by email that the second scheduled hearing would also be heard at 10 30. The Respondent attended for the hearing scheduled for 10 30. There was no appearance by or on behalf of the Complainants. At my request, the WRC tried to contact the Complainants to ensure that there was no misunderstanding regarding the time of the hearing. I was advised that the first mobile phone number went straight to voicemail and the second number rang out. When thirty minutes had elapsed with no show by the Complainants, the hearing was closed. I remained for the original 1 30 timeslot but again there was no appearance by the Complainants.
As I am satisfied that every reasonable effort was made by the WRC to schedule a hearing of the complaint and to notify the Complainants of same, this decision is issued on the basis of there being no appearance by the Complainants in support of their complaint.
Background:
The complaints submitted to the WRC were concerned with an allegation of discrimination based on the ‘housing ground’ contained in the Equal Status Act 2000 as amended. |

Summary of Respondent’s Case:
As there was no appearance and no evidence presented by or on behalf of the Complainant/s at the hearing, the Respondents were not required to provide a submission or evidence at the scheduled hearing. |
Findings and Conclusions:
In the absence of any attendance or representation or evidence to the hearing, the complaint is dismissed without any further inquiry. |
Decision:
Section 25 of the Equal Status Acts, 2000 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 27 of that Act.
