Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint(s) to me by the Director General, I inquired into the complaint(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s).
Background:
The Complainant was employed with the Respondent as a labourer. He commenced his employment on or about the 3rd of October 2022 and his employment ended on or about the 9th of March 2023. |
Summary of Complainant’s Case:
The Complainant failed to attend to make out his case. |
Summary of Respondent’s Case:
The Respondent was in attendance and ready to rebut the allegations made against him. |
Findings and Conclusions:
I am satisfied that the Complainant was notified of the time, date and place of the hearing and failed to attend. In these circumstances where the Respondent was in attendance, I must dismiss all the complaints made against him for want of prosecution as the Complainant failed to attend at the hearing to present his case. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
