Procedure:
In accordance withSection 13 of the Industrial Relations Acts 1969 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant alleges that she was unfairly dismissed from her employment with the Respondent. The Respondent contests the allegation. |
Summary of Complainant’s Case:
There was no appearance for or on behalf of the Complainant for the remote hearing today. |
Summary of Respondent’s Case:
In circumstances where the Complainant did not attend for the hearing the Respondent applied to have the matter struck out for want of prosecution. |
Findings and Conclusions:
There was no appearance for or on behalf of the Complainant today. I note from the file that the Complainant applied on the 23.08.2023 to have todays hearing adjourned. That application was refused, and the Complainant was notified of that by letter dated the 24.08.2023. When the Complainant did not appear for the hearing today, attempts were made by the WRC to contact her by phone. Unfortunately, those attempts were unsuccessful. I am satisfied that the Complainant was fully aware of the date and time of the remote hearing and had been furnished with the hearing link. On that basis I find that the case is not well founded and accordingly fails. In the circumstances I am not making any recommendation. |
Decision:
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.
The complaint fails. |
