Procedure:

In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

Background:

The Complainant is seeking adjudication by the Workplace Relations Commission pursuant to Regulation 10 of the European Communities (Protection of Employees on Transfer of Undertakings) Regulation 2002 (S.I. No 131 of 2003) and has submitted that his current or new employer (Transferee) did not ensure that his terms and conditions transferred from his previous employer (Transferor) – (CA-00046311-001).

The Complainant did not attend.

The Respondent did not attend.

Findings and Conclusions:

Both parties were informed of the hearing of this matter on the 12th April 2022.

Neither party attended the hearing of this matter on the 9th May 2022.

Decision:

Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.

I find that , I find that the Complaint (CA-00046311-001) made pursuant to Regulation 10 of the European Communities (Protection of Employees on Transfer of Undertakings) Regulation 2002 (S.I. No 131 of 2003) is not well founded.
