Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant is seeking adjudication by the Workplace Relations Commission under section 6 of the Payment of Wages Act, 1991 and has submitted that she did not receive her salary for two months nor her redundancy payment (CA-00046817-001). |
Summary of Complainant’s Case:
The Complainant commenced employment with the Respondent on the 1st August 2018. The Complainant was employed as a manager and her gross pay was €2,916.67 (€2,418.43 net) for 40 hours worked per month. The Complainants employment ended on the 30th April 2021 by reason of redundancy. The Complainant submitted she was not receive her wages for March 2021 and April 2021. Further, the Complainant submitted that she did not receive a redundancy payment of €4,008.00 to which she was entitled. This Complaint was received by the Workplace Relations Commission on the 24th October 2021. |
Summary of Respondent’s Case:
The Respondent did not attend. |
Findings and Conclusions:
In the particular circumstances of this case, I accept the uncontroverted evidence of the Complainant due to the non-attendance of the Respondent and find that this Complaint is well founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
I find the Complaint (CA-00046817-001) ) made pursuant to section 6 of the Payment of Wages Act, 1991 is well founded and the Respondent should pay the Complainant the total amount of €8,845.06. |
