Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant did a two-hour trial run at the Respondent café on 05/05/2023, for which she alleges that she was not paid. She alleges that the sum of €23 is due and owing to her, in line with the requirements of the Payment of Wages Act 1991. |
Summary of Complainant’s Case:
No appearance was entered by or on behalf of the Complainant. |
Summary of Respondent’s Case:
The Respondent attended the hearing. The Respondent submits that as neither the Complainant nor her representative was in attendance to pursue the complaint, the complaint should be dismissed for want of evidence. |
Findings and Conclusions:
The complaint was received by the Director General of the Workplace Relations Commission on 5th May 2023 wherein the Complainant alleged that the Respondent employer contravened the provisions of the Payment of Wages Act 1991, in relation to her. The complaint was assigned the complaint application number CA-00056495-001. The said complaint was referred to me for investigation. A hearing for that purpose was arranged for 5th October 2023. There was no appearance by or on behalf of the Complainant at the hearing. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
In all of the circumstances of the matter, I must conclude that the within complaint (CA-00056495-001) is not well-founded and I decide accordingly. |
