Procedure:

In accordance with Section 39 of the Redundancy Payments Acts 1967 - 2014 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

Background:

The Complainant was employed by the Respondent as a machine operator. Employment commenced on 1st February 2017 and ended on 10th February 2023.

This complaint was received by the Workplace Relations Commission on 12th July 2023.

Summary of Complainant’s Case:

The Complainant states that he has an entitlement to a redundancy payment having worked for the Respondent for a period of 6 years.

The Complainant, as per complaint form, states that the Respondent company has gone into liquidation.

Summary of Respondent’s Case:

The Respondent was not present at the hearing of the complaint. I am satisfied that arrangements for the hearing were sent to the Respondent in a timely manner.

Findings and Conclusions:

The Complainant has an entitlement to a statutory redundancy payment.

Such payment should be calculated based on the following:

Start Date: 01st February 2017.

Notice issued: 1st February 2023.

End Date: 10th February 2023.

Weekly wage: €867.96

Weekly hours: 50

Employer Registered Number: 3318060 TH

This statutory redundancy payment should be paid within 42 days from the date of this decision.

Decision:

Section 39 of the Redundancy Payments Acts 1967 – 2012 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.
