Procedure:
In accordance with Section 39 of the Redundancy Payments Acts 1967 - 2014 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant was employed by the Respondent as a machine operator. Employment commenced on 1st February 2017 and ended on 10th February 2023. This complaint was received by the Workplace Relations Commission on 12th July 2023. |
Summary of Complainant’s Case:
The Complainant states that he has an entitlement to a redundancy payment having worked for the Respondent for a period of 6 years. The Complainant, as per complaint form, states that the Respondent company has gone into liquidation. |
Summary of Respondent’s Case:
The Respondent was not present at the hearing of the complaint. I am satisfied that arrangements for the hearing were sent to the Respondent in a timely manner. |
Findings and Conclusions:
The Complainant has an entitlement to a statutory redundancy payment. Such payment should be calculated based on the following: Start Date: 01st February 2017. Notice issued: 1st February 2023. End Date: 10th February 2023.
Weekly wage: €867.96 Weekly hours: 50

This statutory redundancy payment should be paid within 42 days from the date of this decision.

Decision:
Section 39 of the Redundancy Payments Acts 1967 – 2012 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.
