Procedure:

In accordance with s 39 of the Redundancy Payments Acts 1967 - 2014 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard and to present any evidence relevant to the complaint.

On 21 July 2023, the Complainant referred this complaint to the Workplace Relations Commission (WRC). An adjudication hearing was scheduled on 14 December 2023. There was no appearance by or on behalf of the Complainant at the time the adjudication was scheduled to commence. There was no appearance by or on behalf of the Respondent.

I verified that the Complainant and the Respondent had been served with notice of the time, date, and venue of the adjudication hearing. I waited some time to accommodate a late arrival. There was no appearance by the Complainant or the Respondent. The Complainant did not contact the WRC to indicate any difficulty with attending the hearing.

Summary of Complainant’s Case:

The Complainant did not attend the hearing. The Complainant did not adduce evidence to support his complaint.

The Respondent did not attend the hearing.

Findings and Conclusions:

As the Complainant did not attend the hearing and did not give evidence to substantiate the complaint, I disallow the appeal.

Decision:

Section 39 of the Redundancy Payments Acts 1967 – 2012 requires I decide in relation to the complaint in accordance with the relevant redress provisions under that Act.

I decide to disallow the Complainant’s appeal.
