Procedure:

In accordance with Section 25 of the Equal Status Act, 2000, following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.

Despite having been notified of the time and date of the hearing, neither party attended on the day to give evidence.

Background:

The Complainant stated in her complaint form that she was denied access to the Respondent’s premises on 24 May 2021 because she was not wearing a face mask.

Summary of Complainant’s Case:

The Complainant did not attend to give evidence on the day.

The Respondent did not attend to give evidence on the day.

Findings and Conclusions:

In the absence of any evidence having been presented by the Complainant on the day of the hearing, I must find that the Respondent did not engage in prohibited conduct.

Decision:

Section 25 of the Equal Status Acts, 2000 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 27 of that Act.
