Procedure:
In accordance with section 41 of the Workplace Relations Act 2015 and section 79 of the Employment Equality Acts 1998-2015, following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.
Background:
The within complaints were received by the Workplace Relations Commission on 24 August 2021. The Commission notified the respondent and enclosed copy of the complaints on 1 September 2021. A hearing scheduled for 27 July 2022 was postponed on the respondent’s application. A hearing was rescheduled for 29 November 2022. There was no attendance at the hearing on 29 November 2022 by either the complainant or respondent. There was no communication received from either party in relation to non-attendance.

The complainant did not attend the scheduled hearing of her complaints. Notice of the hearing arrangements was sent to the complainant on 13 October 2022. No explanation for the complainant’s non-attendance at the hearing has been received by the Workplace Relations Commission. |

Findings and Conclusions:
The complaints received by the Workplace Relations Commission were referred to me for investigation. A hearing for that purpose was arranged for 29 November 2022. I am satisfied that both parties were notified in writing of the date, time and place at which the hearing to investigate the complaints would be held. In the circumstances and in the absence of direct evidence, I must conclude that the within complaints are not well-founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act.
For the reasons given above, I find that the complaints are not well-founded.
Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
For the reasons given above, I find that the complainant was not discriminated against.
